WA Port Shutdown Deterred

The closure of mining and exports operations at a WA port has been briefly deterred after Clive Palmer’s Mineralogy said it would not process with suspension and termination notices until a trail next year.

Mineralogy currently hold the tenement at Cape Preston, around 100 km south-west of Karratha.

Citic Pacific Mining signed an agreement with Mineralogy to build transport, port and export facilities at Cape Preston.

Mineralogy is now disputing who owns the operating rights, saying they should be vested in Mr Palmer’s company.

The matter will be heard in the Federal Court of WA, with a trail set down for June 2015.

Mineralogy has issued default, suspension and termination notices to Citic Pacific, to shut down their port operations.

Citic filed an application for an injunction on those notices to the Federal Court of WA, that they cannot be issued until the full matter has been heard next year.

On Friday, Justice Michael Barker accepted an undertaking from Mineralogy that it would not act on the default or termination notices until the trial.

The decision means Citic Pacific and its workers at Cape Preston can continue operating, until the case is heard.

Justice Barker also granted respondents' request for confidentiality on material identified as commercially sensitive.
